Terms of Service

These terms apply to the use of Movatile (movatile.com), provided by Dienstverlening Leonardus, Dadelgaarde 18, 2723 BK Zoetermeer, Nederland, Dutch Chamber of Commerce no. 42145386 (”Movatile”, ”we”). By creating an organisation account you agree to these terms. The Dutch version (algemene voorwaarden) prevails in case of conflict.

1. The service

Movatile is an online video platform that lets organisations upload, manage and share videos with their members, customers or staff, including live streaming, courses and statistics. We provide hosting, processing (transcoding, subtitles) and delivery through a content delivery network.

2. Account and trial

An organisation account can be tried free of charge during the trial period (14 days by default), without payment details. After the trial, the environment is closed for viewers until a plan is chosen; data is kept for 30 days. You are responsible for your data, your credentials and everything done under your account, and you are at least 18 or act on behalf of a legal entity.

3. Plans, prices and payment

Plans (Start, Pro, Business) are paid monthly in advance through Mollie. Prices are listed on movatile.com/pricing and exclude VAT. Plans renew monthly and can be cancelled at any time under Admin → Subscription, ending at the end of the paid month; no refunds for a current month. After a failed payment you have 14 days to fix it before we may close the environment for viewers. Price changes are announced at least 30 days in advance by email.

4. Payments by your members

If you charge your members, payments run through your own Mollie account. You are the seller towards your members; Movatile is not a party to those transactions and takes no share.

5. Your content

You keep ownership of everything you upload and grant us only the licence needed to provide the service (store, process, subtitle and deliver to the viewers you authorise). You warrant that you hold the rights to what you upload, including third-party music and footage, and that it is lawful. Content that infringes rights, is illegal, hateful or pornographic is not allowed; on a substantiated notice we may remove content or suspend an account and will contact you.

6. Availability and support

We aim for 99.5% monthly availability, excluding announced maintenance. Support by email (hallo@movatile.com) on business days. Movatile evolves; we may add or change features and will announce important changes.

7. Fair use

Storage and member counts are limited per plan. Video delivery is unlimited under normal use by your own viewers; for structurally excessive use (for example over 10 TB per month) we will contact you to agree on a suitable plan.

8. Data protection

We process personal data as described in our privacy policy. For your members’ data you are the controller and we are the processor; these terms together with the privacy policy form the data processing agreement under the GDPR. Data is stored in the European Union.

9. Liability

We are not liable for indirect damage, lost profit or data loss except in case of intent or gross negligence. Our total liability is limited to the amount you paid us in the six months preceding the damage. Keep your own backups of source files.

10. Termination

You may terminate at any time. After termination we delete your environment and content within 30 days unless a legal retention duty applies. We may terminate in case of serious or repeated breach of these terms.

11. Miscellaneous

Dutch law applies; disputes are submitted to the competent court in The Hague. We may update these terms; the current version is always on this page.
